1. Acceptance of Terms

By accessing and using Simcardo.com ("the Service", "Website", "Simcardo", "we", "us", or "our"), you ("User", "you", or "your") accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

By creating an account, making a purchase, or using our Service, you confirm that you are at least 18 years old or have the consent of a legal guardian, and that you have the legal capacity to enter into this binding agreement.

2. Definitions

  • eSIM: Electronic SIM profile that allows you to activate a mobile data plan without using a physical SIM card
  • Data Plan: Prepaid mobile data package purchased through our Service
  • Activation: The process of installing and activating an eSIM profile on your device
  • QR Code: Quick Response code used to install eSIM profiles on compatible devices
  • Account: Your registered user account on Simcardo.com
  • Dashboard: Your personal user interface where you can manage your eSIMs and orders

3. Service Description

Simcardo provides electronic SIM (eSIM) data plans for international travelers. Our services include:

  • Sale of prepaid mobile data plans (eSIM profiles) for various destinations worldwide
  • Digital delivery of eSIM activation codes and QR codes
  • User dashboard for managing your eSIMs and viewing usage
  • Customer support for activation, usage, and technical issues
  • Online browsing and comparison of data plans

4. User Accounts

4.1 Account Creation

To purchase eSIMs, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. Simcardo will not be liable for any loss or damage arising from your failure to protect your account information.

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may also request account deletion by contacting our support team.

5. Device Compatibility

eSIM services require a compatible device. It is your responsibility to verify that your device supports eSIM technology before purchasing.

Please check our Device Compatibility page before purchasing to ensure your device is supported. Simcardo is not responsible for compatibility issues if you purchase an eSIM for an incompatible device or use it in an unsupported destination.

⚠️ Prohibited: Sharing or distributing QR activation codes to other users or devices is strictly prohibited. Each eSIM is licensed for single-device use only. Simcardo reserves the right to suspend or terminate plans showing duplication patterns, multi-device usage, or fraud indicators without refund.

6. Delivery and Activation

6.1 Instant Delivery

Upon successful payment, your eSIM is delivered instantly. You will receive:

  • A QR code and activation instructions via email
  • Immediate access to your eSIM in your account dashboard

6.2 Activation Methods

  • For iOS 17+: Click the special activation link directly from your email or dashboard
  • For other devices: Scan the QR code with your device's camera or settings app

6.3 User Responsibility

Important: You must verify your device compatibility and ensure you use the eSIM in the correct destination for which it was purchased. Claims or complaints may not be accepted if the eSIM is used with an incompatible device or in an incorrect destination, unless the issue is clearly due to a service error on our part.

6.4 What Counts as Activation

For refund eligibility purposes, activation is considered successful when any of the following occurs:

  • The QR code is scanned or eSIM profile is downloaded to the device
  • The eSIM is installed and appears in device settings (even if not actively used)
  • Data transfer begins through the eSIM connection (even 1KB of data usage)
  • The eSIM profile is activated on the network operator's system

Once any of these events occur, the eSIM is considered "activated" and standard refund terms for activated eSIMs apply.

7. Payment and Pricing

  • All prices are displayed in your selected currency and converted in real-time
  • Payments are processed securely via Stripe, our trusted payment processor
  • Prices include applicable taxes where required by law
  • We accept major credit cards, debit cards, and other payment methods as displayed at checkout
  • All sales are final unless otherwise stated in our Refund Policy

Prices may change without notice. The price you pay is the price displayed at the time of purchase completion.

8. Refund Policy

We are committed to customer satisfaction and offer refunds under specific conditions:

  • Full refunds are available within 14 days if the eSIM has not been activated
  • Partial refunds may be available for activated eSIMs with technical issues not caused by user error
  • Refunds are processed within 5-10 business days to your original payment method
  • Bank processing times may vary

Technical Issues: If a technical problem prevents activation or data usage and cannot be resolved by our support team, the user is eligible for a full refund or store credit.

9. Data Usage and Validity

  • Data plans are valid for the duration specified at the time of purchase (e.g., 7 days, 30 days)
  • Validity period begins upon first activation/use of the eSIM
  • Unused data does not roll over after expiration
  • Data speeds may vary based on network conditions, location, and time of day
  • Fair usage policies apply to unlimited plans to prevent network abuse
  • Network operators may implement speed restrictions after certain data thresholds
  • We do not guarantee specific speeds or coverage in all areas

10. Prohibited Uses

You agree not to use the Service for:

  • Any illegal activities, fraud, or criminal purposes
  • Spamming, mass automated communications, or unsolicited marketing
  • Reselling, redistributing, or sublicensing eSIM profiles without authorization
  • Network abuse, excessive bandwidth consumption, or operating servers
  • Attempting to reverse engineer, hack, or compromise our systems
  • Violating any local laws or regulations in the country where the eSIM is used
  • Using the Service to transmit viruses, malware, or harmful code
  • Impersonating others or providing false information
  • Interfering with other users' use of the Service

Violation of these terms may result in immediate termination of service without refund and potential legal action.

11. Intellectual Property Rights

11.1 Our Content

All content on Simcardo.com, including but not limited to text, graphics, logos, icons, images, audio clips, video, data compilations, and software, is the property of Simcardo or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

11.2 Trademarks

"Simcardo" and all related logos, product names, and service names are trademarks or registered trademarks of Simcardo. You may not use these marks without our prior written permission.

11.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include: (a) resale or commercial use of the Service; (b) distribution, public performance, or public display of any Service content; (c) modifying or otherwise making derivative works of the Service or content; or (d) use of data mining, robots, or similar data gathering or extraction methods.

12. Warranties and Disclaimers

12.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 No Guarantee of Availability

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee specific coverage, speeds, or quality of service, as these depend on third-party network providers.

12.3 Third-Party Networks

Our eSIMs operate on third-party mobile networks. We are not responsible for network outages, coverage gaps, speed variations, or other issues caused by network operators. Any disputes regarding network quality should be resolved according to our Complaints procedure outlined in Section 15.

13. Limitation of Liability

13.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMCARDO'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SIMCARDO FOR THE SPECIFIC ESIM IN QUESTION DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

13.2 Exclusion of Damages

Simcardo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Network outages, coverage gaps, or speed variations
  • Device compatibility issues
  • Issues caused by third-party network providers
  • Damages resulting from user error or misuse
  • Inability to make emergency calls (always maintain alternative communication methods)

14. Indemnification

You agree to indemnify, defend, and hold harmless Simcardo, its affiliates, officers, directors, employees, agents, and partners from any claims, demands, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations
  • Any false or misleading information you provide

15. Complaints and Dispute Resolution

We are committed to resolving any issues or concerns you may have in a fair and timely manner:

15.2 Resolution Timeline

We strive to acknowledge all complaints within 24 hours and resolve them within 5-10 business days. Complex issues may require additional investigation time.

15.3 Escalation

If we are unable to reach a satisfactory resolution within 30 days, you may:

  • Escalate the complaint to the relevant consumer protection authority in your jurisdiction
  • Pursue resolution through arbitration or mediation
  • Exercise your legal rights under applicable consumer protection laws

15.4 Good Faith Resolution

We commit to working in good faith to resolve all disputes fairly and efficiently. Our goal is your satisfaction while ensuring fair treatment for all parties involved.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic and applicable European Union regulations, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Czech Republic, unless otherwise required by applicable consumer protection laws in your country.

For consumers within the European Union, nothing in these Terms affects your statutory rights under EU consumer protection directives, including but not limited to the right to bring proceedings in the courts of your country of residence.

17. Force Majeure

Simcardo shall not be liable for any failure to perform its obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Simcardo regarding your use of the Service and supersede all prior agreements and understandings.

20. Assignment

You may not assign or transfer these Terms or any rights granted hereunder, in whole or in part, without our prior written consent. Simcardo may assign these Terms at any time without notice to you. Any attempted assignment in violation of this section shall be null and void.

21. Waiver

No waiver by Simcardo of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Simcardo to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

22. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
